Cancellation Policy

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

Right of cancellation You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the date on which the contract is concluded. To exercise your right of cancellation, you must inform us (NUXOA GmbH, Hauptstraße 20a, 82216 Maisach, telephone number: +49 8141 31589000, email address: widerruf@nuxoa.de) of your decision to cancel this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model cancellation form for this purpose, but this is not mandatory. You may also complete and submit the model cancellation form or another unequivocal statement electronically on our website at https://nuxoa.de/widerrufsbelehrung/. If you use this option, we will send you confirmation of receipt of such a cancellation without undue delay (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send the communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of cancellation If you cancel this contract, we must reimburse all payments received from you, including delivery costs (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the date on which we receive notification of your cancellation of this contract. We will make this reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you incur any fees as a result of this reimbursement. If you requested that the services begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of your exercise of the right of cancellation in respect of this contract, compared with the full scope of the services provided for in the contract.

Exclusion or premature expiry of the right of cancellation The right of cancellation does not apply to contracts

– for the supply of goods that are not prefabricated and for the production of which an individual selection or decision by the consumer is decisive, or that are clearly tailored to the consumer's personal needs; – for the supply of goods that are liable to deteriorate or expire rapidly; – for the supply of alcoholic beverages, the price of which was agreed when the contract was concluded, but which cannot be delivered until at least 30 days after conclusion of the contract and whose current value depends on market fluctuations over which the trader has no control; – for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of cancellation expires prematurely for contracts

– for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery; – for the supply of goods that, after delivery, have become inseparably mixed with other goods due to their nature; – for the supply of virtual services or virtual goods once these have been sent or made available to the customer; – for the supply of audio or video recordings or computer software in sealed packaging if the seal was removed after delivery.
